Underretning om behandling af personoplysninger for forretningsforbindelser

Brunsgaard A/S (”vi”, ”os”, ”vores”, ”Brunsgaard”) er dataansvarlig for behandling af personoplysninger, som vi foretager af vores forretningsforbindelser.

Efter databeskyttelsesforordningens artikel 13 skal vi give dig en række oplysninger, som følger, når vi behandler personoplysninger om dig.

I forbindelse med din ansættelse hos én af vores forretningsforbindelser behandler vi flere typer almindelige personoplysninger om:

•Dine kontaktoplysninger (fra den virksomhed mv. du er ansat i)
•Funktionstitel
•Indhold af den korrespondance, du har med Brunsgaard A/S

Disse personoplysninger behandles med hjemmel i databeskyttelsesforordningens art. 6, stk. 1, litra f. Brunsgaard har en legitim interesse (litra f) i at behandle oplysninger om dig i relation til din ansættelse hos én af vores forretningsforbindelser. Den legitime interesse består af Brunsgaards interesse i at kunne kontakte og korrespondere med sine forretningsforbindelser.

4. Opbevaring af personoplysninger
Brunsgaard har retningslinjer for, hvor længe vi opbevarer forskellige typer af personoplysninger. Retningslinjerne er fastsat på baggrund af lovgivningen, kategorierne af oplysninger samt formålet med behandlingen. Det betyder, at vi ikke gemmer dine personoplysninger i længere tid, end disse oplysninger tjener det formål, hvormed de behandles.

5. Dine rettigheder som registreret
I forbindelse med vores behandling af personoplysninger om dig har du i henhold til databeskyttelseslovgivningen – med de begrænsninger der følger heraf – følgende rettigheder, som du kan gøre gældende over for os:
• Ret til indsigt
Du har i henhold til databeskyttelsesforordningens art. 15 ret til at få indsigt i de oplysninger, som vi behandler om dig, samt en række yderligere oplysninger.
• Ret til berigtigelse
Du har i henhold til databeskyttelsesforordningens art. 16 ret til at få urigtige oplysninger om dig selv rettet.
• Ret til sletning
I særlige tilfælde har du i henhold til databeskyttelsesforordningens art. 17 ret til at få slettet oplysninger om dig, inden tidspunktet for vores almindelige generelle sletning indtræffer.
• Ret til at trække dit samtykke tilbage
Hvis vores behandling af dine oplysninger sker på grundlag af dit samtykke, kan du til enhver tid trække samtykket tilbage. Hvis du tilbagekalder samtykket, må vi fremover ikke længere behandle oplysningerne. Tilbagekaldelse af samtykke påvirker ikke lovligheden af den behandling, der er baseret på samtykke inden tilbagekaldelsen. Hvis vi har et andet lovligt grundlag for behandling end samtykke med et selvstændigt formål – eksempelvis opbevaring af oplysninger af hensyn til overholdelse af reglerne om bogføring – vil denne behandling fortsat kunne finde sted.
• Ret til begrænsning af behandling
Hvis du bestrider oplysninger, som vi har registreret eller på anden vis behandler, kan du i henhold til databeskyttelsesforordningens art. 18 anmode os om at begrænse behandlingen af oplysningerne, indtil vi har haft mulighed for at fastslå, om oplysningerne er korrekte. Hvis du har ret til at få begrænset behandlingen, må vi fremover kun behandle oplysningerne – bortset fra opbevaring – med dit samtykke, eller med henblik på, at retskrav kan fastlægges, gøres gældende eller forsvares, eller for at beskytte en person eller vigtige samfundsinteresser.
• Ret til at overføre oplysninger
Du har i visse tilfælde i henhold til databeskyttelsesforordningens art. 20 ret til at modtage dine personoplysninger i et struktureret, almindeligt anvendt og maskinlæsbart format samt at få overført disse personoplysninger fra én dataansvarlig til en anden uden hindring.
• Ret til indsigelse
Du har i visse tilfælde i henhold til
databeskyttelsesforordningens art. 21 ret til at gøre indsigelse mod vores ellers lovlige behandling af dine personoplysninger.

Du kan gøre brug af dine rettigheder ved at henvende dig til os på ovenstående telefonnummer eller e-mailadresse. Når vi har modtaget din henvendelse, undersøger vi, om det er muligt at imødekomme dit ønske. Vi giver dig svar
så hurtigt som muligt inden for 1 måned, dog senest 3 måneder efter, at vi har modtaget din henvendelse.

Purpose
The processing of the personal data below regarding your employment etc. at one of our business connections has one of the following purposes:
• Customer service
• Contact with suppliers
• Membership of trade association
• Consulting/revision
• Contact with potential suppliers
• Marketing

Categories of personal data and legal basis

Regarding your employment etc. at one of our business connections, we process several types of general personal data:
•Your full name
•Your contact information (at the company where you work)
•Title
•The content of your correspondence with Brunsgaard A/S

These personal data are processed on the basis of the General Data Protection Regulation article 6, paragraph 1, subparagraph f.
Brunsgaard has a legitimate interest (subparagraph f) to process information about you regarding your employment at one of our business connections. The legitimate interest consists of Brunsgaard’s interest in being able to contact and correspond with our business connections.

3. Categories of recipients
We entrust the above personal data to the following categories of recipients:
• Our data processors based on data processing agreements.
If necessary and in relevant extent, we entrust personal data to the following recipients:

4. Storage of personal data
Brunsgaard has guidelines for how long we store different types of personal data. The guidelines are set on the basis of the applicable legislation, the categories of the data and the purpose with the processing. This means, that we do not save your personal data when we no longer have a purpose to do so.

5. Your rights as a data subject
In connection with the personal data, we process about you, you have – according to the General Data Protection Regulation – with the limitations in here as well – the following rights, that you can assert against us:
• Right of access
According to the General Data Protection Regulation article 15, you have the right to view the data we process about you.
• Right of rectification
According to the General Data Protection Regulation article 16, you can ask us to correct inaccurate data about you.
• Right of erasure
According to the General Data Protection Regulation article 17, you have – in special cases – the right to request that we erase data about you before we normally are required to erase such data.
• Right to withdraw your consent
If our processing is based on your consent, you can at any time withdraw the consent. If you withdraw the consent, we are not allowed to process the data in the future. Withdrawal of the consent does not affect the legality of the processing, that is based on the consent before the withdrawal. If we have another legal basis for the processing than the consent – for example storage of data to secure compliance with the Bookkeeping Act – this processing will continue to take place.
• Right to restriction of processing
If you contest data, that we have registered or in other way process, you can, according to the General Data Protection Regulation article 18, request us to minimize processing the data till we have had the opportunity to determine whether the data is correct or not. It you have the right to restrict the processing, we will only process your personal data with your consent (except for storage), for the establishment, exercise, or defense of a legal claim or for the protection of a person or important public interests.
• Right to transfer data
According to the General Data Protection Regulation article 20, you have – in some cases – the right to receive your personal data in a structured, commonly used, and machine-readable format and to have such personal data transferred from one controller to another.

According to the General Data Protection Regulation article 21 – in some cases – you have the right to object to our otherwise lawful processing of your personal data.

You can make use of your rights by contacting us on the phone number or email address above. When we receive your inquiry, we find out whether we can accept your wish or not. We reply as fast as possible within 1 month, however no later than 3 months after we have received your inquiry.

6. Complaint to the Danish Data Protection Agency
